Regulation: Distribution/Posting of Non-Curricular
Materials in Schools
1.0 Durango School District 9-R has established as part of its limited public forum a defined time, manner, and place for distribution and display of non-curricular materials in schools. The Director of Public Information will provide a copy of this regulation to any organization that wishes to distribute or post information in schools.
2.0 The Director of Public Information must approve all non-curricular materials prior to distribution or display in schools. Such approval will be granted if the materials do not contain material that is inappropriate for a school setting as defined in section 3.d below.
3.0 School-related or school-sponsored organizations may display non-curricular materials at each school’s designated information sites and may request that schools distribute non-curricular materials to students and families through student folders.
3.a School-related or -sponsored organizations include:
a) Parent-teacher organizations
b) School accountability committees
c) School-approved student clubs and organizations
d) Approved non-profit, educational, or health organizations that contract with the district, either in writing or by informal agreement, to provide district-approved curriculum materials, educational support services, professional development, social services, or health services in schools
e) Accredited public educational institutions
3.b All non-curricular materials distributed by the school-related or -sponsored organization must include the organization’s name, contact person, and phone number and/or e-mail address.
3.c The organization must provide all copies and bundled in stacks of 25.
3.d The district and its schools will not distribute or display materials of school-related or school-sponsored organizations that, in the judgment of the Superintendent or Public Information Director, would:
a) Cause the district to violate state or federal laws, its policies, or regulations.
b) Promote illegal activity for minors.
c) Promote illegal discrimination on the basis of sex, race, ethnicity, color, national origin, age, religion, veteran status, sexual orientation, or disability.
d) Include words, symbols, or images regarded as lewd, obscene, vulgar, or plainly offensive if communicated by a student on school grounds.
e) Defame or libel a person or organization.
f) Invade the rights of others or interfere with the rights of any individual or the normal operations of the school.
g) Invite students to engage in activities that are offensive to the school community.
h) Significantly impair the ability of school employees to perform their duties.
i) Disrupt the school.
j) Undermine supervisory authority.
k) Result in harm to students.
l) Include for-profit commercial advertising.
3.e Non-curricular materials from school-related or school-sponsored organizations will not include materials or information from non-school-related organizations unless the materials are an integral part of an activity of the school-related organization.
3.f Each school principal will designate how non-curricular materials from school-related or school-sponsored organizations will be displayed on school grounds or distributed to students and/or families. Distribution methods will be the same for all permitted organizations, and may not incur undue expense for the school or district nor create excessive burden on staff.
3.g The district and its schools may restrict or postpone display or distribution of materials from school-related or school-sponsored organizations if display or distribution conflicts with other district priorities. Such restrictions or delays shall apply to all permitted organizations equally.
4.0 Organizations or persons that are not school-related or school-sponsored are referred to herein as “outside organizations.” The district does not have a distict-wide open or public forum policy for outside organizations. However, materials from outside organizations may be displayed and/or distributed to families and students during one school-sponsored activity each semester or, if provided by the individual school, at an information center at each school.
4.a Each school may elect not to designate an information center for materials distribution or display by outside organizations.
4.b Each school may choose the location of the information center, if any, at which non-curricular materials from the outside organization will be distributed or displayed.
4.c Neither the outside organization, nor any school-related or school-sponsored organization or activity will be permitted to disrupt the regular educational program in any building.
4.d Outside organizations may not include
for-profit, commercial advertising in any non-curricular materials.
4.e No school in the district will have an open forum during school hours for activities of outside organizations other than providing space for the distribution of materials. No outside organization representative will be allowed to distribute materials in person.
4.f The outside organization may not advertise its own fund-raisers.
4.g The outside organization is responsible for the cost of providing materials to be displayed or distributed.
4.h Non-curricular materials must include the organization’s name, contact person, phone number and/or e-mail address, and the following disclaimer: “These materials are neither sponsored nor endorsed by Durango School District 9-R.”
4.i No school in the district will distribute or display materials from outside organizations that, in the judgment of the Director of Public Information, would:
a) Cause the district to violate state or federal laws, its policies, or regulations.
b) Promote illegal activity for minors.

5.0 As required by federal law, the district will not deny an outside organization the opportunity to distribute or display non-curricular materials under these regulations because the program, activity, information, or event will be provided from a religious, philosophical, or political perspective.
